Welcome to Prestige Pairs! The terms "we", "us" and "our" refer to Prestige Pairs. Prestige Pairs operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Prestige Pairs is powered by Shopify, which enables us to provide the Services to you.
These terms and conditions, together with any policies referenced in them (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.
Please read these Terms carefully. By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.
Nothing in these Terms affects your statutory rights as a consumer, including under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.

SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms, you confirm that you are at least 18 years old.
To use the Services, including browsing our store or buying any of our products, you may be asked to provide certain information, such as your email address and billing, payment and delivery details. You confirm that all information you provide is correct, current and complete.
You are responsible for keeping your account login details secure and for all activity on your account. You may not transfer, sell, assign or license your account to anyone else.

SECTION 2 - OUR PRODUCTS
We make every effort to show our products accurately. However, colours and appearance may look different depending on your device and screen settings.
We may change product descriptions, discontinue any product, or limit the quantities we sell to any person or region at any time.

SECTION 3 - ORDERS
When you place an order, you are making an offer to buy. Your order is not accepted until we confirm acceptance, and we must receive your payment before we accept it. We may decline or cancel an order, for example if a product is unavailable or a price or description is clearly wrong. If we do, we will let you know using the contact details you gave us and refund any payment in full.
Returns and cancellations are covered by our Refund Policy.
You confirm that your purchases are for your own personal or household use and not for commercial resale.

SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions may change without notice. The price you pay is the price shown when you place your order, as set out in your order confirmation email. Delivery charges are shown at checkout before you pay. For international orders, import duties and taxes are not included and are payable by you, as explained in our Shipping Policy.
Any promotion is governed by its own terms. If those conflict with these Terms, the promotion terms apply.
You agree to provide current, complete and accurate payment and account information for all purchases, and confirm that you are authorised to use the payment method you provide.

SECTION 5 - SHIPPING AND DELIVERY
Delivery times are estimates. We are not responsible for delays caused by carriers, customs processing or events outside our control. For UK consumers, risk in the goods passes to you when they are delivered to you or someone you nominate.

SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including our text, graphics, logos, images and the way they are arranged, are owned by Prestige Pairs or its licensors and are protected by UK and international intellectual property laws.
You may use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, republish or otherwise use any material from the Services without our prior written consent.
Prestige Pairs's name and logo are our trademarks. Shopify's name and logo are trademarks of Shopify. All other names, logos and brands shown on the Services, including the brands of the products we sell, are the trademarks of their respective owners. Prestige Pairs is an independent reseller and is not affiliated with or endorsed by those brands.

SECTION 7 - OPTIONAL TOOLS
We may give you access to tools provided by third parties, which we do not monitor or control. Any use of those tools is at your own risk and on the third party's terms.

SECTION 8 - THIRD-PARTY LINKS
The Services may link to websites run by third parties. We are not responsible for their content, products or practices. Please read their policies before using them.

SECTION 9 - RELATIONSHIP WITH SHOPIFY
Prestige Pairs is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Prestige Pairs. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Prestige Pairs, including any injury, damage or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Prestige Pairs.

SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is covered by our Privacy Policy, and some may also be covered by Shopify's Privacy Policy. Because the Services are hosted by Shopify, information you submit is shared with Shopify and third parties that may be located outside the UK, in order to provide the Services to you.

SECTION 11 - FEEDBACK AND REVIEWS
If you send us ideas, suggestions, reviews or other content ("Feedback"), you give us a free, worldwide, ongoing licence to use, reproduce, publish and display it for any purpose, including promoting our store.
You confirm that your Feedback is your own, is honest, and does not break any law or anyone else's rights. We may remove Feedback that we consider unlawful, offensive or in breach of these Terms.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Information on the Services may occasionally contain errors in descriptions, pricing, promotions, delivery charges or availability. We may correct these at any time. If an error affects an order you have placed, we will contact you before going ahead, and you can cancel for a full refund.

SECTION 13 - PROHIBITED USES
You may use the Services for lawful purposes only. You must not use them to break any law, infringe anyone's rights, harass or harm anyone, transmit false or misleading information, send spam, or impersonate anyone else.
You also agree not to: (a) upload viruses or any other malicious code; (b) copy, resell or exploit any part of the Services; (c) collect or track other people's personal information; (d) use any robot, spider, scraper, AI agent or other automated means to access the Services, except as allowed in Section 14; or (e) bypass or interfere with any security or access controls. We may suspend or close your account if you break these Terms.

14.1 This section applies if you use, allow or deploy an Agent to access, use or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity without direct supervision.
14.2 No Agent may access, use or interact with the Services unless, at all times, it identifies itself and operates in strict accordance with section 14.4. No Agent may access the Services if we have asked it not to.
14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses and interacts with the Services.
14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and give the Agent's name in the user agent string as "Agent/[agent name]"; (ii) not conceal that any access or interaction is from an Agent, including by mimicking human behaviour or completing or circumventing CAPTCHAs or other measures intended to tell computers and humans apart; (iii) answer truthfully any question asking whether interactions are coming from a human or a computer; and (iv) not circumvent any measure intended to block, limit or control how Agents access or interact with the Services.

SECTION 15 - TERMINATION
We may end these Terms or your access to the Services at any time. You will remain liable for any amounts due up to the date of termination. The sections on Intellectual Property, Feedback, Termination, Limitation of Liability, Severability, Entire Agreement, Assignment, Governing Law and Privacy continue to apply after termination.

SECTION 16 - INFORMATION ON THE SERVICES
Information on the Services is provided for general information. We take reasonable care to keep it accurate, but do not guarantee that the Services will always be available, uninterrupted or error-free.
Products you buy from us must be as described, of satisfactory quality and fit for purpose, as required by law. Your statutory rights are not affected.

SECTION 17 - LIMITATION OF LIABILITY
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for any business losses: our products are for personal use only.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be limited or excluded by law, including your rights under the Consumer Rights Act 2015.

SECTION 18 - INDEMNIFICATION
If you use the Services for anything other than personal use, or break these Terms, the law or anyone's rights, you agree to cover any reasonable losses, costs or claims we face as a direct result. This does not apply to your normal use of the Services as a consumer.

SECTION 19 - SEVERABILITY
If any part of these Terms is found to be unlawful or unenforceable, the rest of these Terms will still apply.

SECTION 20 - WAIVER AND ENTIRE AGREEMENT
If we do not enforce a right under these Terms straight away, we can still enforce it later. These Terms and the policies they refer to are the whole agreement between you and us about your use of the Services.

SECTION 21 - ASSIGNMENT
You may not transfer your rights under these Terms to anyone else without our written consent. We may transfer our rights to another organisation, and will make sure this does not affect your rights.

SECTION 22 - GOVERNING LAW
These Terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts. If you live outside the UK, you may also have rights under the consumer laws of the country where you live.

Headings are for convenience only and do not affect the meaning of these Terms.

You can read the latest version of these Terms on this page at any time. We may update them from time to time. The Terms in force when you place an order are the ones that apply to that order.
